Meeting Minutes

Minutes of the Ordinary Meeting of the Parish Council held in the Parish Hall on Monday 17th October 2022 at 7:30pm.

Councillors Present: Tim Cartmell (Chairman), Paul Doherty, Norman Atkinson, John Brown, Angela Glendinning, Ian Shaw, Mark Telford, Alison Young Poole

Also Present: David McGuffie (Clerk), Mike Johnson (County Councillor, Cumberland Unitary Authority Councillor and Leader Allerdale Borough Council).

Alan Tyson (Date clash) sent his apologies and these were accepted. Tony Annison sent his apologies.

The Chairman was authorised to sign the minutes of the Ordinary Meeting of the Parish Council held on 5th September 2022 and the Special Meeting of 22nd September 2022 as a true record.

  • Parish Hall Clock The Council agreed to refund the Parish Hall for the purchase and installation of a 1m diameter clock on the front of the Parish Hall.
  • Notice boards Paul agreed to look at the options and if a suitable unlocked but weatherproof notice board can be found purchase one to replace the board at the school.

5. Hesket Lonning Footpath

The Clerk advised the Council that he had only received one response to date from the landowners on the green route (Hesket Newmarket to the beginning of the Matthew Rudding footpath) and they would allow a footpath to run along the roadside fence. They would allow the footpath to take this route regardless of its’ complete route. Tim agreed to help contact the other landowners.

  1. Caldbeck Public Toilets

Following discussion of the terms included in the grant agreement associated with the Caldbeck public toilets transfer from Allerdale Borough Council, a resolution to accept the grant agreement was proposed by Tim, seconded by Paul and passed by the Council. It was then agreed that the grant agreement should be signed by Norman and Paul on behalf of the Council. Post Meeting Note: The transfer of the public toilets and the £9,000 grant from Allerdale Borough Council to Caldbeck Parish Council has been completed.

Tim confirmed he had written to the neighbouring owners  about the Councils position with respect to moving the existing toilets and the associated costs. The Council discussed the costs and risks associated with the purchase of land at Bracken Heads to exchange as common land for the Caldbeck car park and agreed that the revised cost of ~£16,000 (including planning inspectorate fees) was too high just to achieve the de registration of the car park. The Council agreed that it would have to refurbish the existing toilets. The Clerk was actioned to check if the specification in the report from Nether Row Construction was sufficient to use as a basis for tenders and to get updated costs for electrical installation.

  1. Street Lighting

The site for the Upton streetlight near the Parish Hall was agreed by the owner of Greenways, Allerdale and Parish Council representatives. Allerdale would install the streetlight and ducting to the Greenways driveway by the end of October 2022. Mike Johnson said that he would obtain a firm date for this. Hellon Electrical, for the Parish Council, would then install a supply from the Parish Hall to the ducting so Allerdale could connect the light. It was hoped that the light would be operational by the end of November 2022.

The streetlight (13) located on the first house (1 Beech Cottage) on the corner of The Street and the road leading to Wood Hall was broken and has been made safe. There isn’t sufficient space to fit a power column for a light in its current location and ENWL will not undertake a power connection inside 1 Beech Cottage. Mike Johnson agreed to ask Dave Bryden to find a solution. He also said he would speak to Paul Graham to find out if he knew who had broken the original light.

  1. Caldbeck Green and other conservation issues

a) Caldbeck Green – nothing beyond routine grass cutting.

b) Stadledykes – The dyke fellings have not been removed. Alison to review.

c) Hesket Green – Hesket pond submission to the Allerdale Environment Fund has been submitted.

Millennium plot – Tim, Alison and Ian agreed to see what work was needed.

Caldbeck village clean up day – date needs to be set. Post meeting note – 1st December 9:30 am start meet by the pub, all welcome.

  1. Property Matters

a) Update on car parks

Alan is still to grade and fill holes on both the Caldbeck and Hesket car parks when his schedule allows.

b) The Coach House, Hesket Newmarket.

Property has been sold.

d) The Old Map Shop, Caldbeck.

All actions to do with the easement are complete.

e) Property Working Group.

BT have provided annual and one off wayleave payment amounts for Caldbeck. The Council agreed that it wanted the annual payment.

f) Solar Bollard

The Council agreed that the bollard needed additional fixing as it can be and has been pushed over. Paul was authorised to purchase postcrete for this purpose.

g) Fellside car park– Tim pursuing costs for 12x parking spaces, consulting with LDNPA about the proposals and asking for agreement from LDNPA to use stone from quarry and consulting Natural England about the proposal..

  1. Speeding Traffic in Hesket Newmarket and Caldbeck

Traffic speed measuring in Hesket Newmarket and Caldbeck happened early September – report awaited – a response from Steph Davis-Johnson is awaited: she should be back in the office on Monday 17th October.

  1. Parish Maintenance

Caldbeck Parish Highways priorities – The Parish Council’s ability to help identify Highways priorities will not change prior to the formation of the Unitary Authorities.

EI/18856 – Upton potholes/resurfacing. Requested: 9/10/21, Last followed up: 1/9/22. Progress reported: May 22 Potholes filled, resurfaced but not all white lines reinstated. 1/9/22 Highways have spoken to contractor who says lines will be reinstated this month.

EI/18937 – Historic sign post Hesket Bridge Requested: 10/10/21, Last followed up: 25/7/22. Progress reported: 25/7/22 work ongoing, post stripped back

EI/21838– Sign on road near Park End. Requested: 26/10/21, Last followed up: 15/8/22. Progress reported: 25/7/22 At design stage hope to reinstate this FY.

2x Streetlights (No.2 Heron Rigg and No.19 Caldbeck Bridge) were not working. They were reported to Allerdale and repaired. To be removed from list.

  1. Planning applications and decisions

a) Applications

i) 07/2022/2225 & 07/2022/2226 The Cottage Pasture Lane, Hesket Newmarket. The Council noted the representations from the LDNPA Rights of Way officer and the Ramblers Association about the impact the proposed application would have on the public footpath and agreed that this was detrimental. It was raised that due to lack of onsite parking now the owners and Air BNB users had to park on the road which raised issues for Pasture Lane users and residents. It was agreed that this would worsen as the changes removed a parking place whist increasing the potential number of occupants. The Council agreed to object to the application.

ii) 07/2022/2237 Ratten Row Gate, Caldbeck. The Council considered this application and T/2022/0172 together as the tree application includes the application to remove a tree which is necessary for the extension proposed in the planning application. Following discussion the Council had no issues with the other seven trees or the proposed extension works but felt that the tree that needed to be removed to allow the extension was worthy of consideration for a Tree Preservation Order. The LDNPA would be asked to assess the tree properly.

iii) 07/2022/2248 Burblethwaite, Caldbeck. The Council had no objection to the application.
